§ 32.01  AMBULANCE SERVICE; RATES.

(A)   Ambulance service for the village is hereby established.

(B)   The ambulance service shall exist and operate subject to the following.

(1)   Ambulance and related emergency medical services shall be provided by members of the Village Volunteer Fire Department who will be compensated for their time and skills by the village. The Village Volunteer Fire Department shall oversee and be responsible for the ambulance and related emergency medical services provided pursuant to this section.

(2)   All members of the Village Volunteer Fire Department who provide ambulance and related emergency medical services shall be properly licensed and/or certified as required by the state and Passavant Area Hospital of Jacksonville, Illinois.

(3)   The ambulance service shall operate in compliance with the applicable statutes of the state and the Village Volunteer Fire Department shall, prior to providing ambulance and related emergency medical services, obtain all necessary permits and certifications from the state.

(4)   The ambulance and related emergency medical services shall comply with the rules and policies established by Passavant Area Hospital of Jacksonville, Illinois.

(5)   The Village Volunteer Fire Department shall on a monthly basis apprise the President and Board of Trustees of the ambulance and related emergency medical services it provides.

(6)   Ambulance and related emergency medical services may be provided to individuals residing outside the corporate limits of the village.

(7)   The corporate authorities shall fix, charge, and collect emergency medical service fees for ambulance and related emergency medical services rendered pursuant to this section against persons, businesses, and other entities.

(8)   The following schedule of rates was established for ambulance and related emergency medical services:

§ 32.15  APPOINTMENT AND DUTIES OF VILLAGE POLICE CHIEF.

   (A)   The Village Police Chief shall be a conservator of the peace within the corporate limits of the village; shall enforce or cause to be enforced all ordinances of the village and all laws of the state.

   (B)   It shall be the duty of the Village Police Chief to attend all meetings of the Board of Trustees of the village, to serve all notices in writing when so ordered by the Village Board, and to perform all such other duties as shall be prescribed by ordinances of said village or by any resolution or order adopted by the Board of Trustees in said village from time to time. He or she shall be the supervisor and administrator of the Police Department, its men and women, and its files.

   (C)   The Village Police Chief shall possess the power and authority of a Police Chief pursuant to the statutes of the state within the corporate limits of the village.

§ 32.16  POLICE TRAINING.

The village hereby elects to participate in the program provided for in the state’s Police Training Act, being 50 ILCS 705. Before an individual may commence regular employment as a police officer, he or she must have been certified by the State Local Governmental Law Enforcement Officers Training Board as having successfully completed an approved training course as provided in said Act. Such basic training must be completed by the trainee within his or her probationary period of one year.

§ 32.17  HIRING STANDARDS.

The following rules and procedures for hiring full-time and part-time police officers are approved and adopted by the corporate authorities of the village.

   (A)   For the purpose of this section, the following definitions shall apply unless the context clearly indicates or requires a different meaning.

      FULL-TIME POLICE OFFICER. A police officer who regularly works at least 84 hours per two-week period, occupying a position included in the adopted annual budget that is neither specified part-time or temporary employment.

      PART-TIME POLICE OFFICER. A police officer whose hours he or she works within a calendar year is restricted and do not, in the cumulative, exceed 1,559 hours in a calendar year while working for one or more agencies.

   (B)   The corporate authorities may employ full-time and part-time officers from time to time as they deem necessary.

   (C)   Full-time and part-time police officers shall have all the responsibilities and duties as specified in the general ordinances of the village and as set forth in the statutes and regulations of the state.

   (D)   Full-time and part-time police officers shall be trained in accordance with the state’s Police Training Act (50 ILCS 705/1 et seq.) and the rules and requirements of the State Law Enforcement Training Public Safety Board.

   (E)   To be employed as a full-time or part-time police officer, a person must be certified by the village’s Police Committee and meet the following standards and requirements:

      (1)   Be of good character, of temperate habits, of sound health, and physically and mentally able to perform assigned duties;

      (2)   Be at least 21 years of age;

      (3)   Pass a physical examination;

      (4)   Possess a high school diploma or equivalency certificate issued by the regional office of superintendent of schools, or a diploma based on a GED certificate;

      (5)   Possess a valid State of Illinois driver’s license;

      (6)   Have no prior felony convictions;

      (7)   Any individual who has served in the United States military must have been honorably discharged;

      (8)   Must be eligible for employment in the United States;

      (9)   Must serve a 12-month probationary period; and

      (10)   Full-time officers must reside within the limits of the village within six months of receiving his or her appointment to the Department, or within a 30-minute distance of the Police Department in the village.

§ 32.30  CREATING AND ESTABLISHING A FIRE DEPARTMENT.

   (A)   There was created and established a Fire Department consisting of one Fire Chief, one Clerk, and such other officers, assistant chiefs, and members of said Fire Department as may from time to time be provided for by the President and Board of Trustees of the village.

   (B)   The members of the Fire Department shall hold monthly meetings on the first Monday of each month, and shall, on the first Monday of each October, elect one Fire Chief, one Clerk and such other officers and assistant chiefs as may have heretofore been provided for by the President and Board of Trustees, and each such officer so elected shall hold office for one year, subject to reelection, and until his or her successor is duly elected and qualified.

   (C)   The Fire Chief shall, upon taking office, and not later than the regular meeting held on the first Monday of November of each year, appoint such engine-workers, ladder-workers, hose-workers, nozzle-workers and hydrant-workers, and make such other appointments and prescribe such duties as may be necessary and proper in the organization and effective operation of the Fire Department during the ensuing year. The Fire Chief shall have the control and supervision, subject however, to the order and direction of the President and Board of Trustees, of the Fire Department and all fire apparatus and equipment belonging to said village. In case of fire, the Fire Chief and his or her assistants in their order of rank, shall take command of such fire, and the officer highest in rank shall take command of the Fire Department and direct the management thereof for the suppression of the fire and in the best manner possible. When it may be necessary for the protection of other property to prevent the spread of any fire, the officer in command may cause buildings to be removed, torn down, or destroyed in the best manner possible.

   (D)   The Clerk of the Fire Department shall keep a record of all meetings of the Fire Department and the attendance of the members thereof, the record of all fires and the attendance of the members at such fires, and during the last week of April of each year, file with the Village Clerk a full report of such attendance and fires, which said report shall be made by the Clerk under oath. The Clerk shall also keep such other record, make such reports, and keep and furnish statistics as may be required of him or her by law. He or she shall, at the expiration of his or her term of office, surrender and deliver to his or her successor in office, all books and records in his or her hands as such clerk.

   (E)   It shall be the function and duty of the Fire Department, and every member thereof, to extinguish accidental or destructive fires, to prevent the occurrence or spread of fires, and to enforce all ordinances relating to the occurrence or spread of such fires.

   (F)   (1)   The headquarters of said Department shall be a the regular meeting place of the Board of Trustees, or such other place as said President and Board of Trustees may determine by appropriate resolution.

      (2)   The Fire Department are to enact bylaws to regulate the conduct of its business and activities.

   (G)   The Fire Chief is hereby vested with authority to suspend any firefighter for insubordination or for neglect of duty. All such suspensions shall be reported to the Board of Trustees at its next meeting by the said Fire Chief, said Trustees shall thereupon discharge or reinstate said firefighter as to them may seem best. Resignations of the Fire Chief or of the firefighter must be made in writing and presented to the Board of Trustees for its action thereon.

   (H)   The Fire Chief and firefighter shall receive such compensation as may be from time to time fixed by the President and Board of Trustees.

   (I)   No person shall be disqualified to act as Fire Chief, or as a firefighter, by reason of being a Trustee or other officer of said village.

   (J)   It shall be the duty of all officers of the law having jurisdiction in said village to enforce the provisions of this section and to arrest on view any person who shall be found violating any of the provisions of this section, or who shall hinder, resist, or refuse to obey any officer of the Fire Department in a discharge of his or her duty.

§ 32.31  FIRE CALL CHARGES.

Henceforth, there shall be paid to the village the sum of $500 for each fire call made by the Village Fire Department outside of the municipal limits, the same to be paid by those persons requesting or accepting such fire call service and the Village Clerk and Fire Department officers may adopt such rules and regulations with regard to securing payment of the foregoing charge as they may deem reasonable and proper under the circumstances and may require that proof of insurance affording coverage for such fire call service be filed with the Village Clerk as a prerequisite for furnishing such fire call service.

§ 32.32  FIRE PROTECTION SERVICE TO PROPERTIES OUTSIDE OF VILLAGE.

   (A)   The village is hereby authorized to enter into contracts with owners or occupants of commercial, industrial, residential, and farm property which lies outside the corporate limits of the village to furnish fire protection services, on the following terms and conditions.

      (1)   Those owners or occupants desiring fire protection service pursuant to this section shall pay by May 1 of each year an annual registration fee of $75.

      (2)   The entering into of such contracts for furnishing fire protection services shall not be mandatory on the part of the village, and each request for such services shall be considered individually and approved or denied for such reasons as may be deemed appropriate in the sole discretion of the village and its President, Trustees, employees, and agents.

      (3)   Under the terms of such contracts, the village shall not be obligated to service fires outside the village limits when to do such will unduly endanger property within the village limits and whether servicing a fire will unduly endanger said property shall be solely and exclusively in the discretion and judgment of the village and its President, Trustees, employees, and agents. At no time shall the village, for the purpose of fighting any one fire pursuant to the provisions of this section, supply more than one tanker, one pumper, and seven firefighters, it being understood that the number of firefighters present at the scene is always subject to their availability for firefighting service from day to day.

      (4)   The village is hereby authorized to negotiate for contracts to furnish fire protection services for other governmental agencies and major industrial plants outside the village limits upon such terms and conditions as may be mutually agreeable.

   (B)   There shall be paid to the village the sum of $500 for each fire call made by the Village Fire Department outside of the corporate limits, the same to be paid by those persons requesting or accepting such fire call service and the Village Clerk and Fire Department officers may adopt such rules and regulations with regard to providing information as to the improvements to be served and the location of them and with regard to securing payment of the foregoing charge as they may deem reasonable and proper under the circumstances and may require that proof of insurance affording coverage for such fire call service be filed with the Village Clerk as a prerequisite for furnishing such fire call service.

   (C)   The Fire Department of the village shall provide firefighting and fire protection services outside the village limits only to those owners or occupants who have registered with the village for such service and otherwise complied with the terms and provisions of this section.

   (D)   Services pursuant to this section shall commence on May 1, 1986 or as soon thereafter as the Fire Chief determines that the Department is prepared to render such services.

§ 32.33  VILLAGE FIRE CHIEF.

   (A)   The President, with the consent of the Board of Trustees, shall appoint a Village Fire Chief to hold office at the pleasure of the President and the Board of Trustees. The Village Fire Chief may be removed or dismissed without cause by the President, with the consent of the Board of Trustees of the village, at any time after his or her appointment. A new appointment shall be made by the President and Board of Trustees in a timely manner.

   (B)   The Village Fire Chief shall enforce or cause to be enforced all ordinances of the village and all laws of the state.

   (C)   It shall be the duty of the Village Fire Chief to attend all meetings of the Board of Trustees of the village, to serve all notices in writing when so ordered by the Village Board, and to perform all such other duties as shall be prescribed by ordinances of said village or by any resolution or order adopted by the Board of Trustees in said village from time to time. He or she shall be the supervisor and administrator of the Fire Department, its men and women, and its files.

   (D)   The Village Fire Chief shall possess the power and authority of a Fire Chief pursuant to the statutes of the state within the corporate limits of the village.

§ 32.34  MEMBERSHIP IN THE ILLINOIS MUTUAL AID BOX ALARM SYSTEM.

   (A)   Subject to the limitations set out below, the village will financially compensate volunteer personnel of the Department when such personnel are called to service in any federally authorized interstate deployment, pursuant to the Emergency Management Assistance Compact (EMAC), or in any statewide intrastate deployment authorized by the State Emergency Operations Center, in compliance with and pursuant to the state’s Statewide Emergency Plan.

   (B)   The compensation paid by the village will be an amount equal to the employee’s civilian career pay per hour (if the person is ordinarily and customarily paid on an hourly basis, to a maximum reimbursed amount of 40 hours per week), or an amount equal to the person’s weekly salary (if the person is ordinarily and customarily paid on a salary basis), prorated to the amount of time the employee actually is absent from his or her employment as a result of the deployment.

   (C)   The compensation paid by the village will be adjusted for amounts required to be withheld from the employee’s compensation by federal and state law.

   (D)   At the village’s discretion, the compensation due an employee pursuant to this section may be paid by the village reimbursing the employee’s civilian career employer for the amount of time the employee missed from work, to allow the employee’s civilian career employer to pay the employee in the same manner as the employee would typically be paid.

   (E)   The compensation to be paid by the village will be limited to the compensation based on the amount of time that the employee is actually absent from his or her civilian career employment as a result of the deployment.

   (F)   Unless the village shall later agree otherwise, the maximum amount of compensation to be paid to any employee in any single deployment shall be limited to compensation for eight hours of work missed (if the person is ordinarily and customarily paid on an hourly basis), or an amount equal to 40 hours per week (if the person is ordinarily and customarily paid on a salary basis).

   (G)   The employee requesting compensation shall keep records of the time involved (and mileage requested) in the deployment, which records shall be verified by the command personnel of the deployment.

   (H)   No compensation shall be paid by the village to an employee who is deployed unless that employee actually misses work for a civilian career employer for which the employee would otherwise be compensated. No compensation shall be paid in an amount greater than the amount of salary or wages actually lost by an employee as a result of the deployment.

   (I)   In the event that a deployed employee is authorized by the Fire Chief to use a personal vehicle to travel to and from the scene of the deployment, the village shall reimburse the employee at the then current IRS mileage rate.

§ 32.35  SELECTION PROCESS OF FIRE DEPARTMENT OFFICERS.

   (A)   Other than the specific requirements described herein, nothing in this section should be interpreted in a manner that would amend any prior ordinance as they relate to the employment of a Fire Chief.

   (B)   The Village Fire Department shall have three officers: a First Assistant Chief, a Second Assistant Chief, and a Secretary. There shall be no Treasurer within the Fire Department. Any and all sections of any and all prior ordinances relating to a Fire Department Treasurer shall be vacated as they relate to the existence of, duties of and/or establishment of a Fire Department Treasurer. Otherwise, the prior ordinances shall remain in full force and effect except as amended herein.

   (C)   The officers (First Assistant Chief, Second Assistant Chief, and Secretary) shall be approved by the Board of Trustees upon the appointment by the Village President after and based on the recommendation of the Fire Chief and the results of an election held by Fire Department members. The term of each officer shall be two years, and the terms shall be staggered so that the appointments shall not occur within the same year. The initial terms shall be as follows: First Assistant Chief (two years); Second Assistant Chief (one year); and Secretary (two years). Nothing should prevent reappointment of any officer so long as the officer is re-appointed by the same process described above.

   (D)   The Fire Chief’s recommendation (described in division (C) above) shall be determined by her or his own review of the nominees and by an election by the members of the Fire Department. The Fire Chief’s recommendation is not bound by the results of the election. During the election, each member of the Fire Department (regardless of rank or position) shall receive one vote for each open office. When a vacancy occurs or is set to occur based on the term of the office described in division (C), the Fire Chief shall call an election for the office with 14 days’ written notice to all members of the Fire Department and by posting notice of the election in the Fire Department. Any nominations shall be made in writing and posted in the Fire Department no later than seven days before the election. The election shall take place by secret ballot, and a Village Trustee (who is not a member of the Fire Department) shall be present at the time the ballots are cast to tally the ballots with the Fire Chief. The Fire Chief and present Department officers may, at any time, create a proposed list of procedures to effectuate an efficient election process for approval by the Village President and Board, but the procedures cannot deviate from the basic structure described herein.

§ 32.99  PENALTY.

   (A)   Any person violating any provision of this chapter for which no specific penalty is prescribed shall be subject to § 10.99 of this code of ordinances.

   (B)   (1)   Any firefighter in attendance at a fire who shall neglect or refuses to obey the orders of the officer in command of such fires, shall upon conviction be fined $500.

      (2)   Whoever shall use any fire engine, hose cart, or any other apparatus belonging to said village, for any private purpose, other than the extinguishment of fires, or whoever shall remove the same, or any part thereof, from its place of keeping, or having the control thereof, shall permit such engine, hose cart, or other apparatus to be used for any private purposes other than aforesaid, shall upon conviction be fined not more than $500.
